The San Sebastián City Council considers that the TSJPV’s ruling that protection of the buildings of the Loiola barracks it is “surprising because it is unprecedented” and assumes that it makes its urban plans in this area impossible.
These plans are impracticable after the Supreme Court of the Basque Country partially upheld a Vox appeal and forced the barracks to be included in the catalog of listed buildings in San Sebastián.
Awaiting an analysis presented this Thursday by the Mayor of Donostia-San Sebastián, Eneko GoiaSan Sebastian City Council sources have expressed surprise at: an “unprecedented” judgmentas “the Court determines which elements in the city should be protected, which is unprecedented”.
“This sentence ruins economic appreciation and makes an operation that was good for the city impossible”
“The ruling calls into question all the terms of the agreement we were working on with the Ministry of Defense, which was in its final stages, by creating protections over the barracks buildings that make future intervention impossible,” the municipal sources said.
The conservation of the buildings, required by the sentence, means that the appreciation of the land with which the municipality worked “loses its entire base”.
“The city council tried to address the city’s housing needs by establishing a new area with housing, amenities and public spaces. This ruling destroys said economic appreciation and makes an operation that was good for the city, and it was claimed, impossible for years,” the sources complain.
In the opinion of the city council, the ruling means that, “in the name of protecting the heritage”, the barracks may not be used any more than the military ones.
