Vicente Iborra, suspended for four games

Date:

Yesterday we announced to Sports World that the Levante-Getafe from Copa del Rey leaving the possibility of a harsh punishment to the local player Vincent Iborra after his dismissal in the final moments of the match. An expulsion is the record of Sanchez Martinez collected as follows: “In the 90th minute, the player (10) Iborra De La Fuente, Vicente was sent off for the following reason: For pushing me while the game was stopped, in a collective confrontation between the two teams.“.

A word that, as confirmed yesterday by the Substitute Judge of the RFEF and as we are already promoting in this newspaper, fits article 101 which refers to mild violence against referees. It says the following: “Grabbing, pushing or shaking, or made, in general, by other attitudes towards the referees which, because they are slightly violent, do not prove an aggressive spirit on the part of the agent, will incur a suspension from four to twelve. matches“.

As this is a serious penalty, he must follow it in all competitions that Levante has to play from now on. And this indicates the next three league games (Sporting, Granada and Leganés) and especially the round of 16 cup duel that the Valencian team has to play on January 17, 18 or 19.

As the federative judge’s letter uses as a result of the Valencian club’s appeal: “This Substitute Disciplinary Judge, after studying the arguments and allegations of Levante UD, SAD, and especially, after carefully looking at the video evidence provided, particularly the two videos, understands that it is not possible to appreciate the apparent material error which the Club considers to be concurrent, error which alone is capable of rebutting the presumption of truth of the arbitration act, for reasons to be explained below“.

The ‘granota’ club’s appeal was rejected

The judge begins by reasoning that “In the first place, it should be pointed out that the videographic evidence does not prove the non-existence of the truth presented in the minutes or the patent arbitrariness of the arbitration decision adopted, the images are compatible with what can be seen in the minutes . The two videos attached to the pleadings have been watched countless times, and it has been possible to conclude, as the club admits, that there is a collective confrontation between the two teams, and in particular, the expelled number 10, the mr. Iborra De La Fuente, was immersed in the confrontation, appreciated in the images that he was pushed in a first action, but then it was clearly noticed how he put his arms on the referee and pushed him, extreme It is therefore completely which matches the words of the minutes, which literally include… ‘push myself while the game is stopped’“.

He goes on to say that “It is necessary to analyze, according to what is stated in the pleadings, whether the push was caused by an accidental event or beyond the player’s control or not, the only point that will absolve him from responsibility, but it is here, where this Substitute Disciplinary Judge , does not share the version maintained by the Club, because what can be seen, especially in one of the videos provided, is how the player puts his arms behind the referee and pushed him, without his usual clothes. number 5 as indicated. said, the opposing team pushed the ejected player, but he tried to catch it, but couldn’t reach it.“.

“Whether excessive force was used or not (as alleged), are not issues which this Substitute Disciplinary Judge has jurisdiction to assess, as they fall within the margin of technical discretion of the arbitrator, as stated on various occasions by the Committee of Appeal, the resolution issued by this body on May 11, 2021 serves as an example to them. In short, the images are consistent with what is found on record, and in the absence of evidence distorting it, error cannot be appreciated as manifest material“.

What is seen in the pictures and what the arbitration document says do not match

The judge concluded that “Once the above has been concluded, and since the only thing that will prove the existence of an obvious material error (“obvious or patent”) is the complete inconsistency of what can be seen in the pictures with what can be seen in arbitration law. , that is; that those who undoubtedly exclude the existence of actions included in the minutes, it must be concluded that it does not happen. Consequently, the allegations made by Levante UD, SAD are dismissed, considering the player Mr. Vicente Iborra De La Fuente as the author of an offense classified in article 101 of the Disciplinary Code, with imposition of a four-match suspension and accessory fines. , in the application of article 52 CD“.

Levante now has ten days to appeal against this resolution before the Appeals Committee.
