Movistar, filed for its agreement with Dazn for the Formula 1 World Cup

The National Commission for Markets and Competition (CNMC) opened a disciplinary file against Telefónica Spain for the agreement it reached with Dazn for the exclusive rights of Formula 1 of the 2021, 2022 and 2023 seasons.

As the regulatory body announced this Thursday in a statement, the operator violated certain promises it obtained when it bought Canal + in 2015.

The CNMC authorized that operation subject to certain conditions that were extended into 2020 and lifted at the end of April.

between them, Telefónica had to make a wholesale offer of its own premium channels available to other pay television operators in Spain under fair conditionsreasonable, objective, transparent and non-discriminatory and does not acquire or exploit exclusive rights to broadcast or exploit channels edited by third parties.

However, the CNMC points out that, in the Danz agreement, Telefónica has sublicensed to the British sports platform the exclusive rights to broadcast Formula 1 contests for the aforementioned seasons.

Both parties have also agreed to the conditions under which Dazn allows Telefónica non-exclusive access to its content. and established limitations for third parties to obtain these rights.

Besides, the contract defines the way in which customers contracting Telefónica packages accessing their contents are countedwhich are counted as customers of the platform for the purpose of calculating the guaranteed minimum cost paid for the acquisition of the operator’s channels.

Upon opening this file, a maximum of three months shall commence for the investigation and for its resolution of the CNMC, which has already urged Telefónica to renew this agreement in 2021.

This is not the first time that the CNMC has opened a disciplinary file against Telefónica for violating the obligations and commitments it accepted and led the entity to authorize the purchase of DTS.

In fact, last March, the CNMC authorized Telefónica six million for an offer it launched with Movistar Fusión from April 11, 2021 to August 1 of the same year that included the lease of a mobile phone with obligation to stay.
