Different legal interpretations of the censure motion

As we explained last Saturday in this newspaper, there are two views on the matter. On the one hand, there is a legal interpretation that allows the realization of this tool that requires “First, that it be formed by at least one third of the members of the General Assembly” and secondly, “that it be approved by the majority by two-thirds of the entire membership of the General Assembly, without, in any case, accepting a vote by mail.

In other words, it will need the signatures of 45 members of the current Assembly and then be supported by 91 of the 139 members (there are 140 but the president is not there).

Those who urge to make it effective, hide in the order of disagreement. The one that controls the electoral processes in the Spanish sports federations where it is established that “it cannot be presented in the first six months of the mandate, or when there is between six months and one year remaining until the date when the call for elections may be held. , event to be determined by federal regulations”.

As of this date of September 5, the RFEF It may take until October 11 to present it because the motion is within the time limits considering that the Spanish Federation has Olympic representation at the Paris Games. In these cases, the rule states that these federations must call elections “within two months after the Games.” Since the Games will end on August 11, 2024, the last day of their presentation will expire on October 11. But in addition, the electoral criteria state that it will be a “situation to be determined by the federative criteria”, and the RFEF He set nothing about it. Only that they should be held every four years. Then, in extreme cases, it can be carried out until December 31, 2024.

But then there is another legal interpretation that considers that, by stating the standard “within the next two months”, it allows RFEF to call them from August 12, 2024, the day after the end of the Games. And we would be on term. But they also consider that the term of Luis Rubiales will end in September 2024, since he was elected for a second time on September 21, 2020. Starting from this date, the election must be called at the end of June. This situation will also prevent the aforementioned motion of censure.

The fact is that as soon as the General Assembly of the RFEF has not been called, or the other federative body of great importance, the RFEF Board of Directors.
