The Court of Justice of the European Union (CJEU) has ruled that FIFA and UEFA rules on the pre-authorisation of club football competitions such as the Super League “infringe Union Law”. “This does not mean that a competition like the Super League project must be approved,” the court qualified. “Having questions of a general nature about the rules of FIFA and UEFA, the Court of Justice does not rule, in its decision, on this particular project,” they specified.

“The FIFA and UEFA rules that make any project for a new club football competition, such as the Super League, subject to prior authorization and that prohibit clubs and players from participating in it, under penalty of sanctions, are illegal. This “is because the powers of FIFA and UEFA are not subject to any criteria guaranteeing their clear, objective, non-discriminatory and proportional nature,” the decision says precisely.

The decision of the Grand Chamber, which answers the preliminary questions posed by the Commercial Court No. 17 of Madrid and cannot be appealed, contradicts the opinion of the attorney general assigned to the case, who when he published his non-binding conclusions last year argued that UEFA and FIFA acted in accordance with the law.
