The Court of Justice of the European Union (CJEU) will hold its first hearing on July 11 and 12 if FIFA and UEFA abused their dominant position by blocking the Superliga, a project which still includes Real Madrid, Barcelona and Juventus.
The Court confirmed that the hearing will take place over two days and will begin on the afternoon of Monday, July 11, to conclude the next day, at the headquarters of this European justice body in Luxembourg.
Initial question
The Mercantile Court 17 of Madrid, which has ordered precautionary measures against possible sanctions from UEFA and FIFA on clubs promoting the Super League, referred this question to the CJEU for in a preliminary decision on May 13, 2021 to ask it to determine if there was abuse of the dominant position of both organizations in their opposition to the Super League.
The order also requested that the preliminary decision be processed through immediate procedure and included six questions in court determining the possible existence of abuse of the dominant position of UEFA and FIFA in accordance with community regulations by preventing organization of other competitions outside its scope.
The judge, arguing that he was consulting the CJEU because of the nature and importance of the interests in dispute, after adopting precautionary measures without listening to the defendant (UEFA and FIFA), also asked for consent. to the CJEU of possible penalties. which UEFA and FIFA can use against the clubs behind the Super League project and their players.
Three clubs continue to support the project
The only three clubs that have not yet given up on the project are Real Madrid, Barcelona and Juventus, but Arsenal, Milan, Chelsea, Atlético de Madrid, Inter Milan, Liverpool, Manchester City, Manchester United and Tottenham Hotspur have already done so. .
The promoters of the Super League have demanded in their lawsuit, among other points, to declare that UEFA and FIFA have abused their position on dominance in violation of article 102 of the European agreements by linking power to deciding to prohibit participation in alternative competitions despite the existence of a conflict of interest.
