He Court of Arbitration for Sports (CAS) dismissed the appeals presented by World Athletics and the World Anti-Doping Agency against the decision issued on August 17, 2023 by the World Athletics Disciplinary Tribunal (WADT) in relation to the Nigerian hurdler Tobi Amusanwhere he considers that He has not committed any anti-doping violations and will be able to participate in the Paris Olympic Games.
The Nigerian athlete was initially charged with committing an anti-doping rule violation (ADRV) under Rule 2.4 following three alleged location errors within a twelve-month period.
Amusan received a caution shortly before the World Championships in Budapest in August 2023, where he was sixth in the 100 hurdles, and the CAS was appealed by the Athletics Integrity Unit (AIU), which challenged a first-instance decision of August 17, 2023 that lifted the temporary suspension.
In their respective appeals to CAS, World Athletics and WADA requested the imposition of a two-year ineligibility period.
The CAS held a hearing on January 19, 2024 and, after deliberation, issued a decision this Friday rejecting both appeals.
The CAS Panel unanimously recognized that Amusan had committed two failures to appear, but did not confirm the existence of a failed control, which World Athletics and WADA say would be the third failure to appear committed within twelve months.
Consequently, the CAS Panel concluded that Amusan, the world record holder in the 100 hurdles (12.12), did not commit an infringement and the challenged decision should be confirmed.
