‘Palo’ against Girona

Date:

This Wednesday the Disciplinary Committee announced the penalties on the last day and highlighted the two game suspensions were imposed on Girona player Juan Carlos Martín Corral and physical trainer David Porcel for their expulsions on the last day against UD Las Palmas. A meeting led by the recently promoted Alejandro Quintero

In the first case, and as the referee stated in the minutes, he was sent off in the 77th minute of the match for “deliberately protesting one of my decisions continuously, gesticulating in a high manner from the area of bench.” In addition, physical trainer David Porcel Almendral He was sent off in the 93rd minute of the match for “deliberately protesting and gesticulating one of my decisions from the technical area continuously,” according to the referee’s report.

Girona, in its pleadings, proves that in these cases there is an apparent material error on the part of the judge, exposing in their respective pleadings a version of the facts that is different and far from what reflected in the arbitration report. Furthermore, and according to the resolution “in one case it was stated that the player encouraged his teammates and in the case of the physical trainer that he was concerned about the state of health of a player. Even, for dialectical purposes, both the events are possible and certain, I did not start anything so that, in addition, they both protested and gesticulated, in both cases, continuously.

However, the Disciplinary Committee rejected the allegations because it considered that the allegations did not distort the arbitration report: “There are no reasons that allow the description of the protests of the player and the physical trainer that the subject of the controversy ..Doubting the arbitration version is like inferring something implausible (because there are no reasons for it) that the arbitrator has invented the facts or distorted the truth of the record to conclude that details such as the deliberate method, in some cases raised and in the same cases continuous, as well as the use of actions of the player and the physical trainer, allow the disciplinary body to confirm that no one has made the manifest material error that the club claims in its written allegations”.

As a result, it is agreed:

1. Dismiss the allegations made by Girona FC and confirm the dismissal of its player D. Juan Carlos Martín Corral and the dismissal of his physical trainer D. David Porcel Almendral.

2. Charge to player D. Juan Carlos Martín Corral a penalty of suspension for TWO COMBINATIONS, for the violation of article 127 of the RFEF Disciplinary Code, with the corresponding accessory fine in the application of article 52 of the same text.

3. Impose physical trainer D. David Porcel Almendral a penalty of suspension for TWO COMBINATIONS, in application of the provisions of article 127 of the RFEF Disciplinary Code, with the corresponding accessory fine.” Added to all this is the warning David López, Van de Beek, Arnau, Krekji, Daley Blind and coach Michel.

Now the club can appeal to the Appeal Committee to avoid both missing the next two matches against Leganés and Getafe.
