Al Hilal will not terminate Neymar’s contract

Date:

In the last few hours the possibility has arisen that the Al Hilal terminate the Brazilian’s contract Neymar. A decision as a result of a new injury and after not counting on the Brazilian star for more than a year and after signing in August 2023 from PSG for two seasons with an option for a third.

A decision that, if made, will have several consequences for the Saudi club. The first is that he has to pay the football player for the remaining months of his contract until the end of his contract as stated in the Regulations on FIFA Player Transfer Law. Article 17 regarding breach of contract without just cause states that “in all cases (whether the player or the club breaks the contract), the party terminating the contract is obliged to pay compensation.

Pursuant to art practice compensation provisions. 20 and Annex 4, and unless otherwise stipulated in the contract, the compensation for non-compliance will be calculated taking into account the national law, the characteristics of the sport and other objective criteria. These criteria shall include, in particular, the compensation and other benefits due to the player under the current contract or the new contract, the remaining contractual period, up to a maximum of five years, the fees and expenses that paid by the previous club ( amortized during the validity of the contract), as well as the question of whether the termination of the contract occurs during a protected period.

Annual salary of 160 million euros

And it is precisely the concept of “protected period” that has disciplinary consequences for Al Hilal. A concept that implies that a footballer is protected for the first three years of his contract. A period that is reduced to two in cases where the football player is over 28 years old.

As in the case of Neymaras the Brazilian is currently 32 years old. If the Saudi club breaks the contract with the former Barcelona player early, he will not be able to sign in the next two player contracting windows. The rule says: “In addition to the obligation to pay compensation, sporting sanctions must be imposed on the club that terminates a contract during the protected period, or that instigates the termination of a contract.

It shall be presumed, unless proven otherwise, that any club that signs a contract with a professional player who terminates his contract without just cause has induced the professional player to terminate the contract. The penalty consists of prohibiting the club from registering new players, both national and international, for two complete and consecutive registration periods. “The club can register new players, both national and international, only from the registration period after full compliance with the relevant sports sanction.”

Then if he Al Hilal ending Neymar will have to pay a large sum to the player and the effect of not being able to sign for a year. Considering that the Brazilian’s contract is around 160 million euros, for now such a decision would mean that he would have to be paid a minimum of 80 million euros for the six months remaining on the contract until June 30.
