European justice forces Google to remove links with incorrect information

The Court of Justice of the European Union ruled on Thursday that operators of search engines such as Google must remove the link to content from their results if the person requesting it on the basis of their right to be forgotten declares that the information to which the link leads is “manifestly incorrect”.

In addition, the judgment of the European Court stipulates that the evidence adduced by the person does not have to arise from a court decision issued against the editor of the web page, although it is for the person requesting the withdrawal to prove the manifest error. of the information.

In this sense, the Luxembourg Court indicates that, in order to avoid imposing an excessive burden that could undermine the effectiveness of the right to withdraw links, it is only obliged to provide evidence that it “reasonably may” require are to search.

For this reason, the plaintiff is not required to present before the hearing any previous court decision issued against the editor of the web page in question at his request, not even a resolution of interim measures.

The case comes in response to two managers of a group of investment companies who asked Google to remove from the results of a search on their behalf those that contained links to certain articles critical of the investment model of said TROS.

The plaintiffs allege that these articles contain false factual allegations and are asking Google to remove photos of them that appear as thumbnails in the results list of an image search based on their name.
