ERC proposes to reduce the prison sentence to four years for those who do not benefit from embezzlement

The parliamentary process abolition of the crime of sedition It is advancing rapidly with the aim of having it approved before the end of the year and this Friday marks another important day: the groups must present their amendments and reveal whether the crime of embezzlement will also be updated.

The PSOE, which along with Unidas Podemos is promoting the amendment of the law so that the crime of sedition becomes one of aggravated public disturbances, is speeding up this deadline and preparing its amendments to the text of the penal code reform without going into details about the tweaks which they propose.

However, one of the most controversial points is whether the crime of embezzlementas proposed by ERC and Junts.

Spanish government president Pedro Sánchez opened the door to doing so on Tuesday, though he made it clear that in any case there will be no setback in the fight against corruptiona message in which the Minister of the Interior, Fernando Grande-Marlaska, influenced in Brussels this Thursday.

ERC amendment proposal

ERC intends to make an amendment to the reform of the Penal Code by amending, among other things, sentences of up to eight years in prison for people who make a profit with the crime of embezzlement, and to four years for those who do not allocate public funds for their own benefitaccording to information from ‘eldiario.es’.

As currently written, the crime of embezzlement makes no distinction between people who personally benefit from the crime and those who do notand imposes penalties of two to six years’ imprisonment for those who commit this offence.
