“Don’t risk a criminal record for recklessness,” they insist on the agency
August is the month of the year when most patron saints are celebrated, and many wonder if it is allowed to drink alcohol before driving. Although at the wheel always the amount of alcohol
should be absolute zero, Spanish law allows a maximum level of 0.5 grams per liter in the blood (or 0.25 mg/l of exhaled air), except for novice or professional drivers where the percentage drops to 0.3 (0.15) . Anyone who exceeds the permitted limits should know that from 0.6 mg/l alcohol in the air or 1.2 g/l in the blood you
crime punishable by jail time.
The penalty, as specified by the agency, is three to six months in prison, or up to one year if the driver refuses to submit to the check. Being less than two years old, the judge could -not necessarily- choose to avoid it by imposing a fine or a fine and working in the interest of the community, but here again the DGT insists: «Ris not on having a criminal record for a carelessness”.
–
For car and bicycle riders: The legal maximum in blood is 0.5 grams per liter, or alcohol in exhaled air is never higher than 0.25 milligrams per liter.
–
novice drivers: The maximum permitted alcohol percentage is 0.3 grams per liter in the blood and 0.15 milligrams per liter of alcohol in exhaled air during the two years after obtaining the permit or permit.
–
professional drivers with vehicles with a maximum authorized mass exceeding 3,500 kilograms, vehicles intended for the transport of passengers with more than nine seats, or public transport, school and small-scale transport, dangerous goods or emergency services or special transport: they are sanctioned if they drive with a blood alcohol level of more than 0.3 grams per litre, or breath alcohol of more than 0.15 milligrams per litre.
The amount of the fine for exceeding the permitted alcohol rates is 500 euros and 4 or 6 points, which would become 1000 euros and the withdrawal of 4 or 6 points if the driver had already been fined in the immediately preceding year for alcohol for exceeding the speed limit, as well as the one circulating at a speed exceeding twice the speed limit.
It is a criminal offense if the alcohol content in the exhaled air is higher than 0.60 milligrams per liter or if the blood alcohol content is more than 1.2 grams per liter or when driving under the influence of it.
The sanction in this case would be imprisonment of three to six months or a fine of six to twelve months or community service of 31 to 90 days, and in any case denial of the right to drive motor vehicles and mopeds for more than one and up to four years.
We pay particular attention to drink-driving, which will determine the commission of the criminal offense and in any case driving at a speed of more than 0.60 milligrams per litre.
