Two boys smothered – mother hugged, kissed accused man in court

A hug, a kiss – in the courtroom in Linz, the mother of the boys asphyxiated in Lasberg hugged her husband, who is accused of death by gross negligence. He and his neighbor have to answer for switching on the emergency generator in the house after a power outage. The mother and children had passed out in the resulting exhaust lake, the two- and five-year-old boys died. A ruling is expected later this afternoon.

“It’s not a normal trial,” Judge Petra Fahrenberger began, expressing her condolences to both defendants. The prosecutor also spoke of a tragic accident, but immediately allayed the suspect’s concerns that “someone is being sent to prison today”.

“I’m so incredibly sorry”
“I’m very sorry for what happened,” said the father of the two boys who suffocated in court in Lasberg in Upper Austria last year. After the carbon monoxide accident in the Mühlviertel, in which two children, aged two and five, died and their mother was seriously injured, the father of the children and a neighbor have to answer to court on Wednesday. The judge’s offer to shorten the proceedings was rejected by the lawyers. The defendants must relive the entire tragedy.

According to the indictment, they operated an emergency power generator in the basement that was not intended for indoor use. The father is said to have turned on the generator after an overnight storm that resulted in a power outage before he drove to work in the morning. Some time later, a neighbor is said to have refueled it and put it back into use.

Not provided for ventilation
Both did not provide adequate ventilation, according to the public prosecutor. In the statement, the father admitted that he had forgotten to open the window. During previous power outages, he’s used the unit about half a dozen times and everything worked just fine. In this case, the window was closed. The two children and the woman inhaled the fumes and fell unconscious. All the help came too late for the children.

Blurred memory, loving embrace
Before the lunch break, the boys’ mother was questioned. As soon as she entered the courtroom, the established woman from the Mühlviertel looked lovingly at her husband. The statement itself was short, she can’t even remember the day of the accident, there is only a vague image that she was in the garage with the kids and then started to falter. Then she misses a week memory. When she left, she hugged her husband, who is visibly broken, and the couple kissed – the experience brought them even closer together.

Gross death by negligence
The two suspects are charged with gross negligence, manslaughter and negligent bodily harm. The lawyer for the neighbor who had refueled the unit mainly wants to check the time, since the file says that the garage door was open for an hour in the morning. The defender sees no legal responsibility for the neighbor, who only refueled the device that had already been set up. The sentence is a maximum of three years.
