The union’s legal services understand that several articles of the agreement “are against the law, and ask the Basque Supreme Court to “cancel the term of compliance with the agreement” until the judicial settlement of the lawsuit.
ELA has decided to submit to the Supreme Court of the Basque Country (TSJPV) the Gipuzkoa residence agreementsigned in minority by UGT with three employers in the sector, given the “discriminatory and anti-union“.
This is what the union noted during a press conference in San Sebastián, explaining that, as a “first step”, it has asked the Basque Supreme Court to “leave without effect the term of accession to the agreement” until the judicial decision of the claim.
As stated in a statement, its legal services understand that several articles of the agreement “are against the law because they introduce discriminatory and anti-union parameters”.
If the dispute of the agreement is estimated, ELA understands that the way would be opened to be able to: sue the signatories of the agreement for violation of their freedom of association and claim appropriate compensation”.
ELA recalled that the Limited Effectiveness Agreement was signed on July 29 by the employers’ organizations Adegi, Lares and Garen and the trade union UGT, which, according to what it specifies, has “a 8% representation“.
According to the exchange, the agreement was aimed at “the surrender of the workers through the” strike deactivation which they have maintained for more than 260 days to request improvements in their working conditions”.
