India’s highest court has banned the so-called two-finger test for suspected rape victims in several states. The tests had no scientific basis and would re-traumatize women, it said.
In the so-called two-finger test, doctors use two fingers to assess the elasticity of a woman’s vagina. This is to find out if she is used to sex or not.
“The test is based on the erroneous assumption that a sexually active woman cannot be raped,” said judges of India’s highest court. To believe that is both patriarchal and sexist. The tests have no scientific basis. They would traumatize women even more.
With these arguments, India’s highest court has now also banned two-finger testing in several states. “The evidential value of a woman’s testimony does not depend on her sexual history,” the judges are convinced.
Tests have already ended up in court
In 2013, they had already ruled that the tests were unconstitutional. However, they were still performed. India’s highest court has ruled that the two-finger test should no longer be taught in medical school.
