France regularizes ‘undocumented’ to feed the labor market

The French government wants to regularize “with a dropper” “undocumented” immigrants already present on Gallic territory and who work in sectors “in suspense”, ie in those with very little labor force, such as construction, agriculture or catering . To those immigrants in an irregular situation in France, the executive branch would offer them residence permits for a “profession in suspense”, Interior Minister Gérald Darmanin and Labor Minister Olivier Dussopt announced in a joint interview yesterday. with the newspaper ‘Le Monde’.

This is one of the proposals of the immigration bill that the government of Emmanuel Macron is preparing and which will be discussed by parliament in early 2023. Darmanin summarizes the philosophy of the future French immigration law. The current law dates from 2019.

Unsurprisingly, the right and far right criticized the ministers’ proposal to regularize ‘undocumented immigrants’. The deputy Aurélien Pradié, candidate for the presidency of the Republicans (moderate right), fears that this reform opens the door to “automatic and mass regularization” of undocumented immigrants already living in France, whom he considered “crazy”.

“Behind Gérald Darmanin’s ‘residence permit for occupations in tension’ is actually a right to regularisation, a real attraction for millions of immigrants,” far-right MEP Jordan Bardella warned on Twitter. “The viable solution to trade tensions is to raise wages, not mass immigration,” added Bardella, candidate for president of Marine Le Pen’s National Regrouping party.

“This is not about mass regularization,” Darmamin responded to criticism from the right and the far right. They will be “dropper regulations” based on certain criteria, such as education, the obligation to speak French or a promise to hire an employer, the minister said. Darmanin also vows to crack down on foreign criminals. “If a foreigner commits crimes, he must leave the national territory,” the minister warned in statements to the press in the National Assembly.

The head of the Interior wants to improve the implementation of the deportation orders (OQTF, in French abbreviation) of foreigners who find themselves in an illegal situation on Gallic territory. Currently, only 13% of foreigners with an OQTF are actually expelled from the country.

Darmanin, who is in the far right wing of the government, promises that they will register all immigrants with deportation warrants in the Wanted Persons File. This file is used by the police, gendarmes and customs officers to verify that the person has indeed left France. Currently, only dangerous foreigners are tracked. The minister wants to ‘make life impossible’ for foreigners who have a deportation order, for example by ensuring that they do not receive social benefits or have access to social housing.
