The Provincial Court of Álava has acquitted a Tubacex employee arrested during a solidarity rally with other employees of the company sued in a court in Amurrio, as reported by the LAB union in a statement.

The power station has reported that following last week’s trial, the judge has issued a verdict acquitting the operator “of all charges, following in doubt various points of the statements of the Ertzaintza”.

As he explained, in the ruling “the judge clearly states that it has not been proven that the defendant made an attempt at any time against any ertzaina” and adds that the charges against her “do not prove her guilt”.

“We are being wrongly accused, beaten and persecuted”

In addition, LAB has emphasized that “thanks to the videos recorded that day and presented by the defense, it has more than been shown” that the employee “do not hit or push at any time to an agent”.

“Therefore, the videos completely exclude many of the Ertzaintza’s statements. This makes it more than clear that everything is a police setup to criminalize to the people who gathered in front of the court that day to show their solidarity,” he stressed.

In this sense, the union has criticized the “criminalization strategy carried out by various powers to repress all workers who actively participated in the Tubacex strike and who defended and exercised their rights before it”.

“In all the struggles launched to defend labor rights, workers are unfairly accused, beaten and persecuted, and this has a number of clear culprits: the Basque governmentthrough the police, who made the decision long ago to defend the employers against the defense of workers’ rights,” he insisted.
