In the case of a senior officer from Lower Austria accused of sexually assaulting an employee, the St. Pölten public prosecutor’s office received a complaint on Friday. A test is now taking place.
This was confirmed by the spokesman for the public prosecutor’s office, Leopold Bien, when asked by APA. “On the basis of initial information” the presumption of a violation of sexual self-determination is assumed. The soldier himself denies the allegations.
Provisional suspension
The incident is said to have occurred outside office hours on November 8. A provisional discharge was “ordered immediately”, according to the army. Spokesman Michael Bauer also outlined on Friday how to proceed. On the one hand, the Federal Disciplinary Board decides on the pronounced temporary suspension. This can be confirmed or withdrawn by the authority.
Imprisonment up to two years possible
Before imposing possible disciplinary measures, the judiciary is informed: it needs a final outcome of proceedings or the final closure of the investigation – “then we will see what happens,” the spokesman said. According to the Penal Code, a prison sentence of up to two years is possible within the framework of the standard on which the first information is based – the violation of sexual self-determination.
Defendant has ‘nothing to blame’
The victim received psychological help. According to Bauer, the woman suffered no physical injuries. The suspect himself emphasized on Thursday evening that he “had nothing to blame himself”. He is convinced that “the allegations will be resolved and will evaporate in smoke and mirrors”.
