No criminal charges – Illegal HPV vaccination in children has no consequences

A 10-year-old was vaccinated against his parents’ wishes by a doctor at a school in Marchtrenk (Upper Austria). Their reports have now been rejected by the Wels prosecutor’s office.

“I can’t understand why a doctor’s failure has no consequences,” says Darinka D. indignantly. The woman from Wels (36) is the mother of ten-year-old Aron, who was mistakenly vaccinated against human papillomavirus (HPV) at Marchtrenk secondary school on October 4. The parents had previously ordered that their son not be vaccinated.

Of course the anger was great when Aron suddenly came home with a plaster on his upper arm and complained of pain and discomfort. “A bottomless brutality,” said D., who filed a complaint against the doctor for negligent bodily harm. The public prosecutor in Wels dropped the mother’s declaration after a preliminary investigation because the consequences for the son’s health lasted less than 14 days. Apparently he only complained about vaccination reactions for a few days.

However, the mother then filed a complaint for unauthorized medical treatment. But again, the Public Prosecution Service refrained from starting an investigation – because it must have been intentional. “In my frustration, I asked the Federal President to look into the matter. However, he forwarded my letter to the Cabinet of the Minister of Health asking me to contact me directly. But there was no response.”
