15 years in prison – according to the court, the traffic accident was attempted murder

A traffic accident with three injured people was attempted murder, according to the court. This was decided by the Salzburg jury on Wednesday afternoon. According to the court, a 30-year-old drove into oncoming traffic while intoxicated with drugs and alcohol with suicidal intent. He would have kept it possible that he would kill other road users with him.

A smile appears on the face of Ali C.’s family (30) when the prison guard leads him to room 427 of the Salzburg regional court. The mood seems almost relaxed, although Wednesday is all about the man. His future is in the hands of the jury.

The fact is:
In March 2019, Ali C. caused a head-on collision with three injuries on the B156 in Salzburg’s Flachgau. The man had a blood alcohol level of 1.32 and cocaine in his blood when he drove into the oncoming lane in his powerful Porsche Cayenne S. Shortly afterwards he fled to Turkey. Ali C. was only arrested in Georgia in March.

Attempted murder or gross negligence?
The question in court: was it intent, ie attempted murder? Or, as the defense (RA Kurt Jelinek, RA Peter Macheiner) demands, just gross negligence? Prosecutors believe the young man drove into oncoming traffic with suicidal intent. This is supported by a note from the doctor at the Oberndorf hospital where the man was treated after the accident.

Suspicion of “suicidal tendencies”
In the ambulance letter, the doctor expressed the suspicion of “suicidal tendencies” and had the man examined by a company doctor. They sent him to the Christian Doppler Clinic in Salzburg, where he was examined by a psychiatrist and released the next day. The young man himself denies suicidal intentions and speaks of an accident.

Ex-partner and mother of suspected child puts a heavy burden on the suspect
The most important piece of evidence is probably the testimony of the Turk’s former partner. The 30-year-old reported a violent telephone argument between the suspect and his parents just before the accident in court on Wednesday. You heard me, but you don’t speak Turkish. That’s why her mother-in-law translated.

“If a car comes, I’ll kill myself”
“I keep hurting you guys. I don’t want to do this to you again. I drive into the oncoming lane and if a car comes, I kill myself,” the Austrian recalls the call. She continues: “Suddenly there was a loud bang and then we immediately drove to the scene of the accident.”

A short time later, Ali C. received a phone call from the police. On the same day he went to Munich and bought a plane ticket to Izmir, where he wanted to escape persecution. The young woman also claimed to have a child with the Turk. The young man does not recognize this. She also visited him in Turkey, according to the young woman. The relationship ended when a photo emerged of the young man with several other women.

“I wrote to him that I hate him”
But that wasn’t the only reason. Ali C. hit and threatened her, she states soberly. When the defense attorney challenged the witness and tried to question her credibility, she replied, “I texted him that I hate him. But I didn’t and I still don’t I don’t wish him anything bad from my heart. Maybe he wants to see the little one too.” During her testimony, the witness always appears confident, does not contradict herself and apparently does not have to think long about her answers.

Guilty of triple attempted murder
“I’m very sorry. An error has occurred. But I’m not a murderer,” were Ali C’s closing words. In the end, the passionate plea of ​​his lawyer or his regret was of no use to the 29-year-old. The jury unanimously ruled that the alleged traffic accident was a triple attempted murder. Ali C. now faces 15 years in prison. The verdict is not final. Defense attorney, Kurt Jelinek, filed a nullity complaint and appealed. The prosecutor said not to to appeal.
