In a Viennese hospital, unauthorized access to data from the electronic patient file (ELGA) allegedly took place some time ago. This was confirmed by press spokesmen from the Vienna Health Association and the Ministry of Health at the request of APA.
According to information from “Presse”, the access would have been made through a doctor’s access. Internal Audit has launched an investigation, the results of which are still pending. Neither the Vienna Health Association nor the Ministry of Social Affairs would comment before the completed report was available. All other agencies involved have also been notified and are awaiting the test results.
Those affected must report
Because ELGA data is so sensitive and therefore among the most secure in Austria, any access to it is documented in a log. This makes it possible to check who has access to which data. If someone suspects that his electronic health record has been viewed by an unauthorized authority, he can contact an ELGA-OBST (ombudsman).
These would investigate on behalf of the applicant a suspected data protection breach in connection with an inspection of the ELGA, a statement from the ministry said. If the applicant’s suspicion is confirmed, the ELGA Ombudsman’s office would receive a statement from the office that had the inspection. This is forwarded to the data subject, who can then contact the data protection authority.
Suspect denies crime
The investigation by the internal audit department concerned, among other things, whether the affected employee of a hospital belonging to the Vienna Health Association actually had access to the data himself. The accused himself could not understand the allegations in a written statement to the “press” and stated that it was a quality control in the context of the Covid vaccination campaign, which had seen 2000 workers kicked out for the first time.
She only checked with two employees whether the vaccination data was correct and claimed that she had not seen any other data.
