AMS blocked reference – travel time to work was longer than work time

The Upper Austrian Workers’ Chamber fought for the AMS to lift the blockage of emergency aid for a single father of three children. The man had not previously been offered a job for which the journey there would have been completely unreasonable for him.

For a single father of three children, who had to commute longer than his working hours for a part-time job, the Upper Austrian Labor Chamber fought for the blockade on the AMS voucher to be lifted. The travel time by public transport was longer than the daily working time and the commute to work was therefore unreasonable. It was also not possible for the man to use his own car, the AK reports.

Part time job as a cleaner
The man received emergency care. The AMS offered him a part-time job as a cleaner, reports the AK Upper Austria on Friday. Because the single parent would have had to travel by public transport for longer than his daily working time and travel time and working hours did not seem to be in a reasonable relationship to each other, he did not apply for the offer.

“Reasonable Employment”
The AMS saw this as a refusal to take reasonable work, referenced the man’s car and blocked him from unemployment benefits for six weeks.

Successful complaint
The AK Oberösterreich successfully filed a complaint against the AMS bloc. The man could not use his own car because it needed expensive repairs. Given the low level of emergency aid and the family situation, the costs would be an unreasonable financial burden.

Not an isolated case
Due to the huge rise in the cost of living, the topic of AMS recording bans is currently exploding. “Unjustified and hasty blockages in receiving AMS are unfortunately not isolated cases,” said AK chairman Andreas Stangl. Anyone who opposes a sanction has a good chance: every third person is right.
