The No. 3 Administrative Dispute Commission of Donostia-San Sebastián has recognized the right of three airlines to recover the money they paid as tolls for fees wrongly collected by the Gipuzkoa Provincial Council.
The amount that the Provincial Council must repay these truck drivers has been confirmed, according to sources €10,000 as it is not legally possible to appeal against the ruling, which is final as it concerns an amount of less than 30,000 euros.
The cited sources have explained that the compensation to be paid is linked to the tolls envisaged in the regional regulations approved by the General Assemblies of Gipuzkoa in 2016 and 2018 for the collection of tolls from carriers on high-capacity roads. , which were overturned by the courts.
The decision now passed by the aforementioned Contentious-Administrative Court does not affect the current toll on these roads, as it is governed by a third Foral Ordinance approved by the Foral Parliament in December 2021.
However, the case is being analyzed by the legal services of the Diputación since the casuistry is “quite broad”.
