The ruling of the Supreme Court of the Basque Country annuls the transfer of 14 workers, who have been on strike for more than a thousand days at the request of the agreement.
The Supreme Court of the Basque Country (TSJPV) has ruled that pharmaceutical distributor Novaltia has violated the right to strike with its decision to move 14 strikers to a factory with no activityreported the ELA union on Wednesday, which is challenging the measure.
According to the central in a statement, “the ruling of the Social Chamber of the Supreme Court contradicts” a report by the Labor Inspectorate that “approves” the transfer of 14 workers, who have been on strike for more than a thousand days to demand the agreement.
The court resolution, affirming ELA’s dispute and dismissing the company’s appeal, invalidate the transfer to the Zaratamo workplace of 14 strikers, including the three members of the strike committee and the business committee of said union, announced by management in February 2021, the same source has indicated.
He specified that the above-mentioned labor center was closed and inactive, so “there was no guarantee” of the effective employment of these workers once the strike was over.
The union pointed out that the ruling concluded that “no evidence has made it possible to understand the reason for the assignment of the 14 striking workers to the center of Zaratamo.”
“Thus things are, with the result that only the strikers were brought to Zaratamo and there are no objective reasons to justify this decision – the resolution continues, as released by ELA – we have to understand that in reality it is responding to a will to harm the legitimate exercise of the constitutional and fundamental right to strike, which is why we also declare the nullity of this measure”.
