A 47-year-old had to appear in court on Tuesday for a fatal frontal collision on March 3 in Strobl (Salzburg). A nurse (25) died a few days after the accident. The suspect received a 12-month prison sentence, partially suspended. He has to serve three months. But he probably won’t go to jail. For the court, the case is a textbook example of electronically monitored house arrest.
The Upper Austrian had apologized to the relatives before the trial. He stood trial for his act and expressed his regret. In the process on record: “I’m very sorry. I know it was a mistake, but I can’t undo it.” The night before the accident, he drank six or seven beers and two schnapps with colleagues. In the early morning, however, he got into his car, despite a lot of residual alcohol.
The 25-year-old died in hospital
With 1.2 promille alcohol in his blood, he then ended up in the oncoming lane on the B158 near the Wieshof inn at around 06:30 a.m., where he collided head-on with an oncoming car. The force of the blow was so enormous that it engine block was thrown from one of the vehicles. The occupants, a 25-year-old and a 54-year-old from Salzburg, were taken to hospital with serious injuries. The youngest, a qualified nurse by profession, died in hospital on March 9.
Process took only 21 minutes
The judge kept the trial short in view of the confession and the clear facts. After 21 minutes, she announced the end of the trial – probably also to protect the victim’s visibly moved relatives.
Guilty of negligent homicide!
For the alcoholic, it issued a guilty verdict for manslaughter and bodily harm by gross negligence. The man will have to serve a quarter of the 12-month prison sentence – probably under electronically monitored house arrest. The others have been suspended on probation. In the justification, the judge emphasized the man’s confession and previous orderly lifestyle. The chairman awarded the parents and siblings of the deceased 1,000 euros in mourning compensation. The seriously injured must also receive 1000 euros. The representatives of the private parties had initially demanded 5,000 euros per person. However, for the difference from this amount, the parties involved would have to fight extrajudicially or civilly. The verdict is not yet legally binding.
