A 24-year-old from Burgenland sexually assaulted three children. But he still doesn’t need to go to an institution!
What’s wrong with our justice system? Some baffled observers at the regional court in Eisenstadt asked themselves this question. There, a jury negotiated whether the mentally ill and mentally handicapped Marcel P. should be admitted to the closed psychiatric ward. Because the 24-year-old – he is not sane and therefore cannot go to prison for his actions – grabbed a seven-year-old at a bus stop in Forchtenstein (Bgld.) in December and put his hand in his underpants. It wasn’t until the school bus pulled into the bus stop that he let go of his victim.
Perpetrators who are known to the authorities and yet roam free
This attack could easily have been avoided. Because already in 2016 the perpetrator had abused two other boys. However, court expert Peter Hofmann said at the time that a briefing was not necessary. The same expert has now been consulted by the judiciary. Although he now assumes the perpetrator is dangerous, he recommended suspending the briefing on probation. The court agreed with this view. P. can walk freely with it – under the supervision of his mother, who has been appointed as his adult representative.
Mandatory therapy and probation
All he has to do is undergo outpatient psychiatric treatment (including the use of antihypertensive drugs) and apply for probation. In addition, he is not allowed to approach the children in Forchtenstein. Only if P. violates one of these conditions will he still have to go to an institution.
In Forchtenstein, parents now want to keep a close eye on whether P. really stays away from their children and if not immediately call the police…
