Because she had not reported the death of her child for almost 18 years, a woman was sentenced to six months in prison by the regional court of St. Pölten on Wednesday. The 37-year-old wrongly received child benefit of 30,000 euros.
The woman received the money from the tax authorities from December 2004 – from the birth of her child, who died three weeks later – until November 2022. An amount of 150 euros per month was assumed in the single hearing.
The suspect partially confessed, but claimed to have received the money only in 2008, not least because of an exceptional psychological situation.
“I know that sounds a bit unbelievable,” continues the 37-year-old.

For the single judge, the description was “not entirely unbelievable” in view of the living situation of the suspect at the time. In the event of doubt, approximately EUR 7,000 was deducted from the original damage amount of approximately EUR 40,000 for the period from the end of 2004 to the end of 2008. The act was committed out of “financial distress and a difficult situation”, the judge emphasized, but is of course “nevertheless punishable”.
The conviction for serious commercial fraud by omission is not final. In addition, a probationary period was imposed.
