The Court agreed with the warring Ertzainas collective, which appealed against the Ertzaintza resolution that did not allow the halting of the tram service or the use of the public address system and making noise against the demonstrators.
The Supreme Court of the Basque Country has declared the case null and void order of the direction of the Ertzaintza that limited the protests of the collective Ertzainas in battle before the Basque Parliament, convened for the following three Thursdays in June.
The group of agents appealed against the order of Victoria Landa, director of the body, which found, among other things, that the ertzainas protests could not impede the access of deputies to the Basque parliament, interrupt or use the Vitoria-Gasteiz tram service public address system and whistles making noise, “to allow the normal development of the plenary”.
The Administrative Litigation Chamber has sided with Ertzainas in the fight, so the order has been nullified and will not apply during subsequent protests.
He Basque governmentFor his part, he explained that he had issued the resolution so that the June 1 incidents would not be repeated before Parliament and “above all to ensure respect for public order”. The executive has stressed that it respects judicial decisions, although “not shared in this case”, because “could cause even more harm to the public“, as then, as a result of the protest of the collective, the circulation of the tram was interrupted in the center of the capital of Álava.
