As the spokeswoman for the court, Christina Salzborn, confirmed on Tuesday evening, the Vienna prosecutor’s office has requested that the actor be placed in the so-called enforcement of measures in their indictment in the event of a guilty verdict. Decisive for this is a psychiatric report, which – based on the latest data from forensic research – confirms that the actor has a serious and permanent mental disorder.
The forensic psychiatrist consulted by the judiciary may have concluded that Teichtmeister is sane, but that he committed the offenses charged with him under the decisive influence of a serious and permanent mental disorder. According to the prosecution, this is a so-called seditious act, which is absolutely necessary for any accommodation, because Teichtmeister is accused of acts against sexual integrity and self-determination and is punishable by more than one year in prison.
In any event, what is certain is that the charge now the subject of the proceedings justifies the jurisdiction of a jury panel. During the main hearing, the Senate is also responsible for deciding whether and to what extent the request for placement of the public prosecutor will be granted in the event of a conviction. A conditional suspension of the measure could also be considered.
