The Social Court 11 of Bilbao has sentenced Sidenor and Cofivacasa to joint and several payment compensation of more than 260,000 euros to a worker who subsequently became ill with pleural mesothelioma working with asbestos “without preventive measures”.
Said employee has been working since 1970 Steel from Llodio (Álava) and after the closure of this factory it was transferred to Sidenor, in Basauri (Bizkaia) where he took early retirement in 2009, as reported by the Basque Association of Victims of Asbestos (Asviamie).
At the end of 2018, he was diagnosed with the above-mentioned cancer disease and both the Galdakao Hospital and the Basque Institute for Occupational Safety and Health-Osalan determined that it was a professional illness.
According to Asviamie, he came into contact with asbestos in the two jobs he held at the companies mentioned “without being warned of the risk he was running and without being given adequate protective equipment”.
This association also claims both Sidenor and Cofivacasa to “leave the path” of legal remedies because “several” sentences have established their responsibility in these cases, for which reason they are urged to acknowledge it “at once” and “choose to repair the damage caused”.
