In the trial at the regional court in Wiener Neustadt, which has been ongoing since last November, over the sale of mineral oil and tax evasion in the millions, the remaining defendant was found guilty of financial crimes and fraudulent Krida on Thursday. The verdict: five years and nine months in prison, a fine of one million euros and a penalty of four million euros.
There were three and a half years and the fines in the financial criminal proceedings, for the crime of fraudulent Krida were added two years and three months. The verdict is not final because the defense has filed a nullity complaint and appeal.
Ten defendants in the beginning
Originally there were ten defendants. There have been two convictions and four acquittals in recent months. The proceedings were discontinued in two other cases, one suspect is abroad and did not appear at the trial. In May, two women were not legally sentenced to years in prison and each was fined a million euros.
Illegal pan-European trade
Between July 2010 and July 2013, 85 million euros in tax on mineral oils and approximately 38 million euros in sales tax were not paid. The suspects allegedly declared excisable mineral oil as an excise-free universal technical oil in the exercise of their managerial functions in various European companies – some of which were set up especially for this purpose. The substance would have been traded throughout Europe without paying the taxes and customs duties due. The crime scene includes Leobersdorf (Baden district).
The investigations ran for years and became public knowledge in early 2015. At the time, several suspects were said to have been taken out of circulation by German and local financial investigators. With regard to the discontinued proceedings, according to court information in Germany, the respective defendants from the freight forwarding sector have already been fined in similar cases. The possibility of an additional fine was not seen.
