A 39-year-old man sits in the quay of the Eisenstadt regional court with his shoulders down and his head bowed. His lawyer Manfred Arbacher-Stöger summarizes what everyone in the room can probably see: “He has been a broken person since the incident.”

Five-year-old drowned in wave pool
It was supposed to be a family trip to the Sonnentherme Lutzmannsburg, but it ended horribly. The father spent 20 minutes in the restaurant and outside the thermal baths. He left his five-year-old daughter alone at the pool.

“Alone and without swimming aids” little Dunija jumped into the 1.90 meter deep wave pool. A swimmer saw the lifeless child floating in the water. The girl died in the Donaustadt clinic in Vienna. “He violated the attention he was supposed to have as a supervisor,” the prosecutor says in his charge of murder by gross negligence.

“I wish I were dead!”
The 39-year-old father cannot say much about the terrible swimming accident. After the first sentence, he bursts into tears: “I would like to be dead!” he sobbed in court. Which also doesn’t bother the Viennese with questions. Witnesses are no longer needed – after all, he admits that he was responsible for the death of his daughter through gross negligence.

“He will only be able to forgive himself for this fatal mistake at the end of his days,” argues his lawyer Arbacher-Stöger. What happened is already the highest punishment…

The trial of Dunija’s tragic death took less than 45 minutes before a verdict was passed: her father was sentenced to a six-month suspended prison sentence, which is not legally binding, and also had to pay a fine of 2,700 euros. The girl’s mother and sister each receive compensation of 15,000 euros.
