This case should also be a lesson for other citizens: like members of other households (specifically 25,000 per quarter), a Tyrolean was also randomly asked to participate in the statistical survey (microcensus). This concerns internationally comparable data on the employment and housing situation.
Interview and further steps
The procedure is quite complex: a personal interview is followed by up to four telephone surveys, and the follow-up appointment is also possible online. The Tyrolean apparently had no interest in it. “Of five surveys, only the third was conducted by telephone,” the administrative court summarizes – after the person concerned was fined 250 euros for non-participation and lodged an objection.
Many attempts to call, followed by RSb letters
The court notes that fifteen attempts were made to contact the man by telephone. When he actually answered or called back and heard the name Statistics Austria, he immediately hung up. Even a reminder letter by RSb letter had no effect. The objection that you do not have time due to your work is not a reason for refusal. “These investigations can also be carried out during the weekend,” the State Administrative Court writes very clearly.
Refusal is considered a crime of disobedience
Ultimately, the Tyrolean was charged with a so-called crime of disobedience. His objection failed and the payment, including a contribution to the legal costs, increased to a total of 275 euros. Statistics Austria writes unequivocally on its homepage: “There is an obligation to provide information for the micro-census. Every randomly selected household must participate in the study.”
