25-year-old convicted – girl dragged to disco toilet and raped

A 25-year-old stood trial in Graz for allegedly raping a 17-year-old girl in the toilet of a bar in Deutschlandsberg, Styria. The jury does not believe this was a voluntary act. He was sentenced to four years in prison, which is not legally binding.

The 25-year-old defendant entered the interrogation room in Graz on Friday wearing a T-shirt with the inscription ‘Fuck off’. “Interesting shirt,” says the judge. “I didn’t have a new shirt anymore,” he explains. You could almost think that the Turkish-born man is not aware that he is on trial for a serious crime: in December 2022, he allegedly followed a then 17-year-old boy into the ladies’ toilet of a disco in Deutschlandsberg and raped her there .

“I kept saying no”
“He suddenly stood in front of me, pushed me into a booth and pushed me against the wall,” the girl reported when questioned by police a few days after the alleged crime, which was shown in court. She describes in detail how he abused her: “I was in shock at first, but then I kept saying no. But he didn’t want to understand me,” she says. Only after a few minutes was she able to catch herself and escape from the toilet.

The day after the crime, she confided to her mother: “To this day she cannot go to the toilet alone,” says the girl’s mother, describing the impact on her daughter. “She was a happy person, but very withdrawn.”

The defendant denies the allegations
However, the defendant vehemently denies the allegations and speaks in court of a consensual sexual act. The girl kissed him in the bar, he says. Two witnesses also confirm this. However, they cannot testify to what happened in the toilet afterwards.

Four years in prison – not legally binding
After the verdict was announced, the judge made it clear: “It doesn’t matter how the young woman behaved beforehand: as soon as she says no, it means no. And if you continue, that is rape.” The man was sentenced to four years in prison and 5,000 euros in compensation. He was surprised by the ruling and asked for three days to think about it. The judgment is therefore not yet legally binding.
