Perpetrator and victim were once friends. Both met in a difficult phase of their lives: in a psychiatric hospital. He was there for alcohol addiction, she for mental health. They exchanged numbers and met at her apartment on September 21, 2021. “It was a nice evening until he asked for sex, which she refused,” prosecutor Sandra Wimmer of the Public Prosecution Service said during the trial in the regional court on Wednesday. Instead of leaving, the 47-year-old lay down in the woman’s bed and suddenly told her, “I’m going to rape you.” Then came sexual acts. However, the woman was able to successfully defend herself shortly afterwards.
Drank a liter and a half of wine before the crime
“The whole thing has contributed to a deterioration of her health,” emphasizes victim advocate Stefan Rieder. But the father cannot remember this incident. Lawyer Moritz Knauseder describes it as a “film tear” and explains: “My client is deeply shocked by the accusations. He cannot rule it out and will therefore express his regret.”
The suspect himself thought that he had simply fallen asleep that evening after drinking one and a half liters of wine, he told the judge. “I never want to experience such a loss of control again.” After the incident, he stopped drinking and has been sober for a year.
The judge emphasizes that a confession in such cases is “very rare” and announces a probation period of 20 months plus a fine of 960 euros, which is not legally binding.
