Because the spray on his potatoes made his neighbor’s rocket crop unsellable, a farmer from Germany has to pay almost 80,000 euros in damages. This is the ruling of the Supreme Court in Zweibrücken (Rhineland-Palatinate) on Monday.
The arugula that had been blown by the wind to the adjacent field made the arugula unsellable. The spray that the potato farmer used on his plot was not approved for arugula. The salad was therefore no longer allowed to be sold.
The neighbor then filed a lawsuit arguing that there had been crop damage. According to the Frankenthal court, the amount was 77,078.32 euros. At the time of the damage, costs had already been incurred for seeds, irrigation or crop protection, the report said. The compensation to be paid now amounts to almost 80,000 euros. In any case, the potato farmer from the Rhine-Palatinate district was deducted from the saved expenses for harvesting costs and packaging the rocket.
The court concluded that responsibility for the damage lay solely with the neighboring potato farmer.
