Not an easy case, as the lay judges of the regional court of Korneuburg (Lower Austria) hear. And not an easy decision to make when it comes to judgment. Especially since the accused Viennese vehemently denies the crimes: “I am completely innocent. It tore the ground out from under me. “I would never think of something like that in my life,” claims the 34-year-old tram driver in the federal capital.
He is accused by the public prosecutor of sexually abusing and raping his ex-partner’s daughter – over a period of two years, starting when the now 16-year-old girl was ten years old.

“The allegations only arose during a dispute over the custody of their children and after my client was awarded sole custody of the two,” said lawyer Andreas Reichenbach.
However, a friend and the girl’s first boyfriend confirmed the victim’s descriptions of the attacks on the living room couch: “The first time we did it, she started crying. Then she told me everything,” said the witness. After long deliberation, the jury returned a guilty verdict for sexual abuse and abuse of power: 30 months in prison, not legally binding.
