The guilty verdicts for murder and terrorist offenses in the terror trial surrounding the attack in Vienna on November 2, 2020 are legally binding. The charges of crimes committed by terrorist groups and criminal organizations are being retried.
The trial of several supporters of the Viennese attacker, which ended in February 2023 with life sentences for two suspects and long prison sentences for two other men, must be repeated in parts. After an appeal for nullity, the Supreme Court partially annulled the guilty verdicts of five suspects. However, convictions for committing terrorist offenses in combination with involvement in murder are legally binding.
According to the OGH, the convictions for the crimes of the terrorist group and the criminal organization have been quashed. The reason for this was an error in the legal instructions given to the jury and insufficiently specific wording of the verdict, according to a statement from the Supreme Court.
This did not affect convictions for contributing to murder and terrorist crimes, nor did it affect convictions under the War Materials Act and the Weapons Act. A jury at the Vienna Regional Criminal Court must now decide again on the indictment aspects of the terrorist organization and the annulled criminal organization.
