Suspicion of abuse – educators are not yet allowed to return to the children

Suspected child abuse in Vienna. However, the Public Prosecution Service discontinued the procedure after a year and a half due to a lack of evidence. The city of Vienna is still investigating and wants to clarify whether the transferred teachers can work with children again. There are also civil lawsuits against parents.

The case caused a stir in May 2022. Two employees of a kindergarten in Penzingen are said to have sexually abused their children. A small group MA10 had been investigating such suspicions for a year and a half. But neither the parents nor the responsible city council knew about it. This is reported by the ‘Krone’.

Transferred to “internal service”.
The teachers were taken out of child labor and transferred to the “internal service”. And there they will remain until further notice. The Public Prosecution Service closed the investigation due to lack of evidence. But MA11 (youth welfare) resumed its investigation on Wednesday.

The aim is to clarify whether “redeployment of employees in child care is possible”, according to the “Krone”. A psychological expert is called in, the people around those affected are interviewed and information from the criminal record is requested.

Parents sue the kindergarten
The civil proceedings are also continuing. Penzingen’s top lawyer Johannes Bügler represents two groups of parents of possible victims who are suing the city of Vienna as the operator of kindergartens.

The process specialist advocates a reversal of the burden of proof: “The community must prove that everything was actually in order. And not the victims after so long.” The alleged attacks are said to have taken place more than three years ago.
