No paid work – drug dealer sues the health insurer

Finanz classifies the sale of cocaine as paid work. The Labor Market Service and the Austrian Health Insurance Fund therefore demand the return of social benefits, but the person concerned goes to court.

The Austrian Health Insurance Fund (ÖGK) is currently facing a rather strange lawsuit. Because a “bizarre and illegal tax claim by the tax authorities” – at least from the claimant’s point of view – has now resulted in social law proceedings at the Krems Regional Court.

Explosive detail: The plaintiff himself is no stranger to the judiciary. The man is currently incarcerated in Stein Prison, serving a long prison sentence for various drug offenses. In concrete terms, this concerns reimbursement demands from the dealer. “The tax authorities classified me as self-employed based on an overview of the sales and income tax that I had to pay for the sale of cocaine and cannabis,” the drug dealer explains to the “Krone”.

The result: “The employment service and the ÖGK demanded their benefits back because as a self-employed person I would not be entitled to benefits.” That was too much for the convicted criminal. He quickly decided to change sides and fight against ‘injustice’. He then sued the ÖGK for unlawful reimbursement demands.

The tax authorities are also complaining
“I expect that the tax authorities will justify the tax claim and hope to find out where I can apply for the necessary business permit,” said the prisoner. He also intends to file a lawsuit against the tax authorities and the official involved. From the drug dealer’s point of view, there is no independence. For him, it is astonishing “how authorities waste time, waste taxpayers’ money and harass people in a senseless way.”
