Shortly before the holidays, ‘Krone’ reader Ali T. from Gänserndorf is happy with money he thought he had already lost: the 50-year-old has been a customer of the mobile phone company Drei for years and has never seen that they charge annual fees a “service fee”. When he discovered an online clawback option from a litigation funder to get back the hated fee, he entered – and won.
“I am very satisfied. “It’s nice when justice prevails,” says Ali T. about his battle over the service costs. It took a long time before a lawyer from Graz, on behalf of a major litigation funder, got the recovery through: “ We started the lawsuit last year – and now we have won.”
The barrier to entry was low: “We had to submit invoices from previous years and disclose some data,” Mr Ali continues. He was satisfied with the executive lawyers, who received a 34 percent commission for their work. But the case raises questions: After initial successes, are the Telekom companies now threatened with an avalanche of lawsuits? Is this the end of the hated service charges? Krone+ investigated.
