Austrian judges also have to deal with school grades, as shown in the case of a student from Salzburg. The girl attended class 4C of a compulsory school in the state. But it turned out that she was not very good with numbers and formulas: on the final certificate for the 2022/23 school year she gave a “five” in mathematics – not enough.
Also failed the re-examination
The student failed the resit exam again in September. Ergo: She would have to repeat the eighth grade – the application of the promotion clause was not possible because she already had a “five” in mathematics in the previous school year.
Just two days after the failed exam, the young person filed a complaint with the Directorate of Education. Reason: The test was incorrect. The school management then gave the girl another chance: in the form of an exam. In writing she barely achieved a “satisfactory” rating, but verbally it was a more than clear “not enough”. Ergo: The overall result is again a school grade of 5.
The Supreme Court dismissed the appeal
The student has submitted a complaint about this again. – Tenor: This test was also insufficient. She claimed, among other things, that some of the tasks were not learned at all and that the exam was administered under “great time pressure”. It was the turn of the Federal Administrative Court, studied all the documents and also recognized that the young person had arrived 27 minutes late for the final exam. The other arguments also did not hold up: “In summary, the assessment was correct,” the court’s ruling states.
