There is a lot of stress, there is a lack of staff and nerves are frayed – the hospitality industry often has rough morals. But the manager (48) of a well-known restaurant in Innsbruck went one step too far on June 1, 2023.
The defendant wanted to confront the ‘lazy dog’.
However, what exactly happened on June 1, 2023 in the staff apartment in Innsbruck-Igls could not be precisely reconstructed even during a trial at the Innsbruck Regional Court. At least the southern Italy native admitted to kicking in the door. The reason: his cook was blue. “The lazy dog claimed to be with his sick mother in Italy, taking care of her and therefore unable to work,” the feisty defendant saw red. He wanted to confront his employee and “get him to work.”
He was insulted and grabbed by the arm
The 48-year-old allegedly threatened to kill the employee with a gun in his hand. “Nonsense, there was no weapon involved,” the 48-year-old vehemently denied this accusation. A witness who could possibly have provided clarity in court as to whether there was “just” a fight or whether the boss actually brandished a gun did not appear. Ultimately, it became clear to the judge that the defendant insulted the cook very seriously, grabbed him by the arm and loudly ‘asked’ him to pack his things and leave.
Full appeal filed
A semi-suspended fine of 1,040 euros was imposed on the Italian. The innkeeper didn’t like this at all. After a brief, impulsive consultation with his lawyer, he immediately filed a full appeal.
