In the case of little Elias, the Supreme Court changed the sentences for the parents from Salzburg. The baby was shaken to death by his parents in October 2022 when he was just seven weeks old.
Six months after the trial against the parents of little Elias, who died of shaken baby syndrome in October 2022 at just seven weeks of age, the Supreme Court (OGH) on Wednesday reduced the sentences for the father and tightened those for the mother.
Defense attorneys had sought lighter sentences for both parents, while the prosecutor had called for higher sentences. The mother now legally has to spend 18 instead of 16 years in prison, the father ten instead of twelve years.
Murder and ongoing violence
The now 21-year-old mother was convicted of murder and persistent violence. The 26-year-old father was convicted of persistent violence and bodily harm resulting in death – in both cases due to negligence.
