AK-Bilanz – Man on sick leave terminated via WhatsApp

Unjustified dismissals, unpaid overtime or information on a wide range of questions in the field of labor law, insolvency and social law: last year, AK’s legal protection experts carried out a total of 125,550 consultations.

The Chamber of Labor presented its balance sheet on legal protection on Thursday. Last year, a total of 65.9 million euros was won for Carinthian employees. There were a total of 125,550 consultations. The “Career, Family and Equality” department covered 12,000 people, with research mainly on the topics of maternity protection and parental leave, but also on support and family benefits. There were more than 1,225 new replacements in the social sector last year. This concerned disability pensions, disability pensions, compensatory allowances, but also applications for rehabilitation benefits and a nursing allowance.

In 479 cases, employment law advice in the previous year ended in a lawsuit. In total, there were 2,058 labor laws that could be successfully completed. The top topics from the consultation remained unchanged. “Just like last year, this concerns pay slips, incorrect classifications, termination of employment and unpaid overtime. We can help our members by intervening and, if necessary, taking legal action,” says Max Turrini, head of labor and social law at the Carinthian Chamber of Labor.

Termination due to illness
A perennial favorite, according to AK experts, is layoffs during sick leave. One employee was particularly hard hit: the man had been working in a company for 32 years and had to go on sick leave after an accident at work. After a few weeks, the man on sick leave received a WhatsApp from his company informing him that he would now be deregistered and would no longer be employed. During a conversation, it was also made clear to the employee that he was ill due to the accident and was therefore not needed. The employee turned to the AK because the notice periods were not observed and payment of severance pay to the AK was refused. After intervention, the experts managed to obtain an out-of-court settlement of 75,000 euros.

Request a dismissal ban
“Employees are not protected against losing their jobs while on sick leave. That is why I once again call for a ban on dismissal during sick leave,” said AK President Günther Goach.
