In 2023, a Carinthian man was beaten up and has been struggling with the consequences ever since: his nose is deformed and he has problems breathing. But the young man has to wait two years for the necessary operation in a public hospital. If he wants his turn earlier, he has to pay. That’s why he has now filed a lawsuit.

Klagenfurt civil judge Daniel Binder does not conduct a trial like this every day: It is not just about the usual claims for compensation for pain and suffering after personal injury – but rather about why a crime victim in Austria should wait two calendar years before being treated for his injuries at a public hospital, necessary surgeries for recovery.
