A judicial resolution from the Social Court Number 7 of Bilbao acknowledges that the company worked with asbestos in the 1970s and 1980s without taking measures to protect the health of employees.
Petronor must pay a benefit surcharge of 50% (the maximum) on the pension of the widow of a company employee who died from a pathology resulting from exposure to asbestosaccording to a judicial resolution of the Social Court Number 7 of Bilbao.
The ELA union has reported that the ruling recognizes as proven that asbestos was worked with asbestos in a worker passage area in the 1970s and 1980s “without there being any physical separation or any means of extracting it”. It is also stated that the airborne dust reached the mechanical workshop where the deceased employee worked, who did not work directly with asbestos, but was exposed to the dust.
The ruling, ELA added, found that the company “failed to take safety measures” to protect the health of workers and that “the airborne dust circulated without any aspiration measures.”
Headquarters believes this ruling is “important” because it is the first time it has acknowledged Petronor’s responsibility for its own employees, as convictions have been issued for employees of subcontractors to date. ‘It opens the way for the family of the deceased employee legal actions to claim damages.”
