Father and son accused – trial in Graz: broiler chickens crushed with tractor

The farmers – father and son – who have to appear in court in Graz today are 83 and 55 years old. The younger man drove a tractor over the defenseless animals in the chicken coop. According to the prosecutor, the elderly man did not kill the surviving animals, but left them to fend for themselves.

The first defendant, 83, has difficulty understanding what Judge Martin Heissenberger is saying; he has to repeat his words again and again. The elderly Styrian and his son (55) have never had anything to do with the court. Your lawyer speaks of a campaign that draws attention to animal suffering. He understands that too, but many of the cases denounced are not relevant to criminal law, if only to administrative law. Since the incident, enormous damage has been caused to the family. “The company was removed from the AMA and blocked, its life’s work has disappeared. All I can say about the incident itself is that the video is obviously horrible to watch. But that was an accident.”

“The AMA is partly to blame”
What he lacks is a lack of feeling for how fattening in Austria actually works. In this system, the fattening pig is just a small cog in the system for which the consumer does not want to pay anything. “And the AMA is partly to blame. After incidents, it distances itself from companies that have met all requirements.” The indictment is actually an indictment of the system. A system in which the fattening pig has no say in the decision. It is impossible for an individual to control 30,000 animals. It was an accident that his client ran over a chicken with the tractor.

He shows remorse: “You don’t do that as hard work, I’m sorry. I would never deliberately kill an animal. I went backwards into it. It’s always dark here. Only the charger gives a small light. Where I drove, there are usually no chickens. When it’s dark, they don’t move. Normally I can always drive there. “This has never happened before.” But the animals that were run over could be seen in the beam of light, the judge pointed out to the suspect. “It only moves when the tire rolls over it.” “I didn’t see it,” the defendant claims.

His elderly father is said to have killed not two of the surviving, but seriously injured chickens. However, Judge Martin Heissenberger is unsure of his ability to stand trial and would like to seek an expert opinion on the matter.

From the perspective of the expert, an official veterinarian, running over and not killing the two surviving animals must be seen as brutal abuse. He recognizes a total of five chickens brought together, two of which are still fluttering afterwards. “The robbery should never have happened. If the animal dies immediately, at least it has not suffered any pain. The surviving animals must have suffered at least three minutes of unnecessary torture and associated pain. You just have to be careful while driving.”

No verdict will be delivered at today’s hearing due to the lack of an expert opinion on the 83-year-old’s ability to stand trial. It’s postponed.
