Driver in court: risky ride costs a young life

An 18-year-old boy from Pasching died shortly before Christmas after a fatal accident in the Bindermichltunnel in Linz. The 22-year-old driver – he had collided with a shock absorber – now stood before the judge and was convicted of murder by gross negligence.

On November 23, 2023, a then 21-year-old from Pasching traveled too fast and too risky in the Bindermichltunnel in Linz towards Freistadt. With fatal consequences: Shortly before midnight, the young man raced over a barrier line without reducing his speed and then crashed into a shock absorber separating the third lane of the main road and the Muldenstrasse exit.

Died eight days after the accident
The crash injured one of his passengers – a Russian (19) who lived in Linz and was sitting in the back seat behind the driver – so seriously that he died eight days later at the Kepler University Hospital in Linz. Another passenger, a 16-year-old boy from Pasching, was unharmed. The driver – he is now 22 years old – now had to answer to the Linz Regional Court for the serious accident that resulted in death. The public prosecutor accused the young man of “murder by gross negligence” and was threatened with up to three years in prison. During the trial before a single judge in Linz, a video recorded by one of the young boys at the time of the fatal accident was shown.

However, because the Paschinger was fully confessed and blameless during the trial, the sentence was not so severe. That meant twelve months in prison, three of which were unconditional and the rest conditional. However, the verdict against the 22-year-old is not yet final.
