Was it negligent homicide or gross negligence? Maximum one or three years in prison – expert judgment determines the maximum sentence Josef G. (49), who caused the fatal accident in Kleinzell (Upper Austria), should receive. He may keep his driver’s license, which he had to surrender shortly after the accident, until further notice.
“Immediate withdrawal of the driver’s license, even for a longer period, is only possible in the event of intoxication by alcohol or drugs,” explains Valentin Pühringer, deputy district governor of Rohrbach. Because officers found Josef G.’s behavior suspicious after last Friday’s accident, they called the company doctor, who wrote Rohrbacher unfit to drive. “I was on my way to the hospital for a check-up. The blood sugar when driving off was fine and I was fine. After the accident I was upset,” the 49-year-old said in the Krone interview. And that a little later he got his driver’s license back “when I was back down”.
“If the temporary incapacity to drive due to medication, health problems or fatigue has passed, the driving license is issued again,” explains Pühringer. But also that there is now an administrative procedure that checks fitness to drive. A decision will be made in two to three weeks.
The Rohrbach man who caused the fatal crash says he has a driver’s license limited to three years because of seizures “which only happen when you’re sleeping”.
He cannot or will not explain why he was unaware that he hit two cars while overtaking before Sarah Schoenberger’s car (28) flew into a bus when the maneuver failed. He remembers the crash well. Now the Public Prosecution Service must assess whether his behavior was negligent, one-off or grossly negligent, so that it was avoidable.
